Welcome to Happy Pages! The terms "we," "us," and "our" refer to Happy Pages, a service of Challengers United Inc. Happy Pages operates this store and website, including all related information, content, features, tools, products, and services (the "Services"). Happy Pages is powered by Shopify, which enables us to provide the Services to you.

Please read these Terms of Service carefully. By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.

Section 1 — Access and Account

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence and that you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.

You may be asked to provide certain information such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of your account credentials and for all account activity. You may not transfer, sell, assign, or license your account to any other person.

Section 2 — Our Products

Happy Pages offers custom-made coloring books created from photographs you upload. Each book is unique and produced specifically for you using AI-powered image processing and print-on-demand manufacturing.

We have made every effort to provide an accurate representation of our products and services in our online store. However, colors and product appearance may differ from what you see on your screen due to device settings and display variations. The quality of your finished coloring book depends in part on the quality of the photographs you upload.

All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product at any time and to limit quantities at our discretion.

Section 3 — Your Uploaded Images

By uploading photographs to our Services, you represent and warrant that:

(a) You own the photographs or have obtained all necessary rights and permissions to use them.

(b) The photographs do not infringe on any third party's intellectual property, privacy, or other rights.

(c) If the photographs depict other people (including minors), you have obtained their consent (or the consent of their parent or guardian) for the photographs to be used in creating a custom coloring book.

(d) You understand and consent to your photographs being processed by third-party AI and image processing services, a third-party print-on-demand partner, and secure cloud storage infrastructure as described in our Privacy Policy.

You retain ownership of your photographs. By uploading them, you grant us a limited, non-exclusive license to use, process, and transmit your photographs solely for the purpose of producing and delivering your custom coloring book order. This license terminates when your images are deleted from our systems.

Section 4 — Orders

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order at our discretion. Your order is not accepted until we confirm acceptance and process your payment.

Because each product is custom-made from your uploaded images, orders cannot be cancelled once production has begun. Please review your order carefully before submitting. If we are unable to accept, need to change, or must cancel an order, we will attempt to notify you using the contact information provided at the time of the order.

All purchases are subject to our Return and Refund Policy.

Section 5 — Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed. Unless otherwise stated, posted prices do not include taxes, shipping, or handling charges.

You agree to provide current, complete, and accurate purchase and payment information. You represent that any credit card information you provide is true and correct, that you are authorized to use it, and that charges will be honored by your card issuer.

Section 6 — Shipping and Delivery

Your custom coloring book is manufactured by our print-on-demand partner at one of their global production facilities before being shipped to you. Normal production times are 3 to 5 business days before shipping.

Shipping times vary by destination and shipping method selected. All delivery times are estimates and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, incorrect addresses, or events outside our control.

Once we transfer your product to the shipping carrier, title and risk of loss pass to you. For more details on shipping options, estimated transit times, and country availability, please refer to our Shipping Policy page.

Section 7 — Intellectual Property

Our Services, including all trademarks, text, images, graphics, designs, and other content, are owned by Happy Pages, its affiliates, or licensors and are protected by applicable intellectual property laws.

You may use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, or create derivative works of any content on the Services without our prior written consent. All rights not expressly granted are reserved by Happy Pages.

Section 8 — Third-Party Links and Services

The Services may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of any third-party sites. Accessing them is at your own risk. Please review their terms and privacy policies before engaging with them.

Section 9 — Relationship with Shopify

Happy Pages is powered by Shopify. Any purchases you make are made directly with Happy Pages. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and Happy Pages. You expressly release Shopify and its affiliates from all claims arising from your transactions with us.

Section 10 — Disclaimer of Warranties

THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE ABOVE MAY NOT APPLY TO YOU.

Section 11 — Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HAPPY PAGES, CHALLENGERS UNITED INC., SHOPIFY, AND THEIR RESPECTIVE PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS, EVEN IF ADVISED OF THEIR POSSIBILITY.

Section 12 — Indemnification

You agree to indemnify, defend, and hold harmless Happy Pages, Challengers United Inc., Shopify, and their affiliates from any losses, damages, liabilities, or claims (including reasonable attorneys' fees) arising out of your breach of these Terms, your violation of any law or third-party rights, your uploaded content, or your use of the Services.

Section 13 — Prohibited Uses

You may access and use the Services for lawful purposes only. You may not use the Services to violate any law, infringe on intellectual property rights, harass or harm others, transmit false or misleading information, upload malicious code, or engage in any activity that interferes with the Services or exposes us or our users to liability.

Section 14 — Agents

If you deploy any automated Agent (as defined as any software or service that takes autonomous or semi-autonomous action) to interact with the Services, such Agent must identify itself in all requests, must not conceal its automated nature, and must comply with any measures we implement to control automated access. We may limit Agent access at any time.

Section 15 — Privacy Policy

All personal information we collect is subject to our Privacy Policy. By using the Services, you acknowledge that you have read our Privacy Policy and Shopify's Privacy Policy.

Section 16 — Feedback

If you submit any ideas, suggestions, feedback, or other content, you grant us a perpetual, worldwide, sublicensable, royalty-free license to use such feedback for any purpose, including to improve the Services. You represent that you own or have the rights to any feedback you submit.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States. You consent to the jurisdiction of the federal and state courts located in Delaware.

Section 18 — Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on our website with an updated "Last Updated" date. Your continued use of the Services after changes are posted constitutes acceptance.

Section 19 — Severability and Waiver

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right or provision does not constitute a waiver.
